Fire in Lancaster County Injures Firefighter

Lancaster County Fire at ResortNews today comes out of Lancaster County where a Firefighter was seriously injured while battling a blaze. The fire broke out at the Eden Resort in Manheim Township located on Route 30. Flames engulfed the structure late last night, and thankfully, all the patrons were able to make it out safely. The terrible fierceness of the fire forced all guests to flee the building without their belongings.

Generally, a fire such as this one will result in numerous injuries and/or deaths. It is fortunate that most people, whether patrons, staff, or rescuers, were able to escape the blaze unscathed. Sadly, one firefighter did have to be rushed to the hospital. The name of the firefighter who was injured has not yet been released, although his injury is not that different from many construction accidents that occur on an all-too-often basis.

Officials say that the fire had burned for more than an hour and a half, swallowing up several rooms before it was finally put to rest. While numerous firefighters were on the scene, the fire was not under control for quite some time. Nevertheless, it wasn’t the flames that injured the firefighter as he was struck by falling debris caused by the fire. Currently, he is expected to be okay.

No matter the cause, at Edelstein, Martin & Nelson, we understand the dangers that so many workers face every day. An average day in the life of a firefighter, construction worker, or police officer, among many other professionals can bring about very dangerous conditions. Relative Negligence in Pennsylvania Slip and Fall Accidents

Slip and Fall Accidents in PennsylvaniaNo matter how cut and dry and downright honest your claim may be, when it comes to a slip and fall, responsible parties are always looking to shed liability. The responsible party is always, and usually rightfully so, on the look-out for scammers. It might be a sad truth, but it’s a truth nonetheless that many people have attempted to attain fraudulent compensation for phony slip and fall accidents. Because of these “one rotten apple” sort of circumstances, the defendant in your case will most likely be looking to shift the majority of the blame over to you.

Modified Comparative Negligence

You can feel the need to blame the responsible party or corporation if you wish, but that does not change the laws. The fact is that law in Pennsylvania requires the states’ Modified Comparative Negligence rules to be enforced. This rule determines exactly how much compensation you may be eligible for by stringently deciding your percentage of fault in the accident.

It is vitally important that you understand all of the ins and outs of your specific case. Every slip and fall accident can vary, at least slightly, if not tremendously. The courts need to understand each and every detail of your specific suit in order to award the proper judgment. This might seem pretty simple, nevertheless, it is something that you need to be incredibly familiar with if you wish to pursue compensation for your slip and fall accident.

Regardless of the person or corporate entity, you are up against, the fact that he/she or they do not want to give away their money remains a common factor. You will need a lot of preparation, and being prepared for every facet of your claim to be analyzed will definitely not hurt you.

Understanding the Extent of Your Coverage

In an average slip and fall case, you might be searching to be compensated for several things beyond the personal injury itself. These are things such as medical bills, lost wages, pain and suffering, and property losses among other economic damages. A property loss in a slip and fall case might include something like damaged jewelry or device(s) as a result of the accident.

No matter what, the extent of your coverage is unlimited in the sense that you are completely not at-fault. The first and foremost thing to understand about your coverage is that in Pennsylvania, that coverage only extends if you are less than 50% responsible for the accident. It is tremendously important that you understand several factors in your case.

Be aware that the liable party will be looking to prove several things, all of which are specifically outlined in Pennsylvania Training for Health and Safety. Among the circumstances that the liable party will be looking to prove are things like trespassing, being distracted, inadequate footgear for the specific location, and caution signs such as cones and other brightly colored notices of dangerous territory. It is extremely crucial that you are familiar with these rules, and that your claim is a cut and dry case of negligence on behalf of the person and/or establishment of whom you are looking to recover damages.

At Edelstein, Martin & Nelson, we fully understand the stringent rules applied to slip and fall cases. We are terribly familiar with the need for innocent victims to prove their case against a system that may not trust their claims entirely. If you have a legitimate case for a slip and fall accident, please do not waste any time, and call 888-208-1810 now!

What to Do in Case of an Accident with a Commercial Vehicle

Commercial Trucking Accident - Law PAWith the constant flow of traffic soaring through busy streets, the cities of Pennsylvania are no different than any other city throughout the country. A high number of vehicles on the road only leads to the greater possibility of an accident, and in our fast-paced environment where the never-ending transportation of goods is a must, accidents involving commercial vehicles can always be expected.

In the event of such a crash, the very first steps you need to take are fairly similar to those of any other kind of accident, save for a few very important exceptions. Nevertheless, you are going to want to follow all the same precautions such as taking pictures and filing a police report. However, commercial trucking accidents are hardly the same as a regular car accident.

The Major Differences

In a regular motor vehicle accident, you will simple swap insurance information with the other driver, but in the case of dealing with a commercial vehicle, you are not just dealing with an insurance company. Commercial vehicles also involve a third party, being that of the company that owns the truck. This is one of the biggest differences, as well as the fact that the company has their own investigators, attorneys, and so on who will likely be dispatched to the scene of the crash immediately. Commercial trucking companies have a lot of overhead costs, and they need to protect themselves.

This makes it twice as important to have your own photographs and documentation. This also means you are going to need the best legal representation as most commercial truck companies have a well-organized and highly experienced team of lawyers on call. You can be absolutely positive that whichever commercial vehicle company you are dealing with; they are not going to make obtaining compensation easy.

Fighting for Accurate Compensation

If you think proving you are not at-fault in a regular accident can be difficult, commercial vehicle companies can make this task a nightmare. Commercial companies will employ every weapon of defense they have in order to ensure they are held liable for as little as possible. In all honesty, the largest problem with this besides the obvious financial battle is that accidents involving commercial vehicles tend to create a lot more damage than any other kind of accident.

Accidents with commercial trucks typically leave vast amounts of property damage that the company does not want to be responsible for compensating. Moreover, these accidents generally cause catastrophic injuries and of course, a company is not going to want to pay for your hospitalization, medical bills, lost wages, etc. All of this makes obtaining compensation terribly difficult, but it is not at all impossible.

At Edelstein, Martin & Nelson, we have a solid track record of obtaining all the financial compensation you deserve from your commercial trucking accident. Commercial vehicle companies have a lot of tenacity and the tireless ability to protect themselves in every possible way. The fight for compensation can be a long and treacherous battle, but you will feel safe and comfortable knowing you have the best legal representation in your corner. If you have been the victim of a commercial trucking accident, don’t hesitate to call 888-208-1810 today!
