In Lancaster yesterday morning, a 19-year-old woman unfortunately suffered a fatal accident. According to the Manheim Township Police, the woman lost control of her vehicle and was killed in a crash while she was traveling, striking a tree. She was pronounced dead at the scene and the accident closed down a road for approximately 5 hours. What if a wrongful death accident stems from the fault of others? What can be done in these cases?
Reckless Actions in Wrongful Death Accidents
No matter how you want to look at it, there are always risks that come with driving. There is a lot of information out there about reckless driving, but that doesn’t mean that drivers will always abide by it. There are always some drivers who will not obey the rules of the road and it will lead to an accident, sometimes deadly. In 2014, 3,179 people were killed in motor vehicle accidents, all of which involved distracted drivers.
There are many reasons for the fatal accidents that happen on our roads every year. Some common negligent reasons for accidents involve texting and driving, driving under the influence of drugs, reckless driving, driving poorly in bad weather conditions, fatigue, and many other reasons. If someone you love has been killed in a wrongful death accident, you may wonder if you can bring suit against a negligent party for their actions, the reason of your loved one’s death.
However, for you to file a wrongful death suit, you must be the immediate family member of a loved one. This means somebody like the child of the deceased, or even the parents. If you are the personal representative of the estate that files the suit on behalf of the deceased’s family members, your case will generally go well.
If you believe that your loved one has been wrongfully killed in a crash, you may have the right to recover on their behalf. Give us a call today to talk about your case at Edelstein Martin & Nelson. We want to hear from you today at 888-208-1810.
